HOW DO I DETERMINE IF I AM ELIGIBLE FOR RELIEF UNDER ARIZONA LAW?
A simple way to determine if you qualify to have your conviction set aside is to review the requirement checklist of Arizona Revised Statute 13-907 Arizona Setting Aside Judgment of Conviction, Release From Disabilities:
- Did your case involve the infliction of serious physical injury?
- Did your case involve the use or exhibition of a deadly weapon or dangerous instrument?
- Were you required to register pursuant ARS 13-3821?
- Did your offense involve sexual motivation pursuant to ARS 13-118?
- Did your offense involve the victim being a minor under fifteen years of age?
- Did your offense result in a traffic infraction?
If you answered NO to any of these questions, you are eligible to seek relief under Arizona law.
