Florida Expungement Checklist

HOW DO I DETERMINE IF I AM ELIGIBLE FOR RELIEF UNDER ARIZONA LAW?

A simple way to determine if you qualify to have your conviction set aside is to review the requirement checklist of requirements pursuant to Florida Statutes 943.0585(2) and 943.059(2).

Was the adjudication of guilt withheld in your case?
Have you completed your probationary period without violation?
Are you eligible to obtain a Certificate of Eligibility from Florida Department of Law Enforcement?
Is your offense a disqualifying offense listed in S.907.041, F.S. ?
Have you ever had a prior criminal record expunged or sealed in Florida?
Have you ever been convicted of a Felony or Misdemeanor in Florida?.

If you answered YES to the first three questions and NO to the last three questions, you may be eligible to seek relief under Florida law.

In seeking this relief, you are required to obtain a Certificate of Eligibility from the Florida Department of Law Enforcement prior to the filing of a Motion to Seal or Expunge your record of arrest. You must be fingerprinted by authorized law enforcement personnel or a criminal justice agency. The fingerprint form must include your personal information and must be signed and notarized. A certified copy of the disposition of the case must also be submitted with the application. A Non-Refundable money order or cashier’s check for $75 dollars must accompany the application. Upon issuance of a Certificate of Eligibility, the proper motions can then be filed with the Court.
